Welcome to Moab Utah Properties. These Terms and Conditions apply to reservations made directly through Moab Utah Properties, including reservations made through booking.moabutahproperties.com and other websites operated by Moab Utah Properties.

By accessing our website, making a reservation, or staying at one of our managed vacation rental properties, you acknowledge that you have read, understood, and agree to these Terms and Conditions, as well as the specific policies and house rules applicable to the property you reserve.

For purposes of these Terms, “Guest,” “You,” and “Your” refer to the person making the reservation and all members of the reservation party. “Moab Utah Properties,” “We,” “Us,” and “Our” refer to Moab Utah Properties and, where applicable, the owner of the reserved property.

Reservations

The individual making the reservation must be at least 21 years of age unless otherwise stated for a specific property and must have the legal authority to enter into this agreement on behalf of all guests occupying the property.

The reservation holder is responsible for ensuring that all members of the party comply with these Terms and Conditions and all property-specific rules.

Reservations are not considered confirmed until required payment has been received and a booking confirmation has been issued.

Rates, Fees and Taxes

Reservation rates are based on the property, dates, length of stay, number of guests and other applicable booking details.

Guests are responsible for all charges shown at the time of booking, which may include:

Nightly rental charges

Cleaning fees

Applicable state, county and local lodging taxes

Pet fees when applicable

Additional guest fees when applicable

Optional services or add-ons

Other fees disclosed before the reservation is completed

Applicable taxes and required charges will be displayed during the reservation process.

Rates and availability are subject to change until a reservation has been confirmed.

Payment

Payment terms will be displayed during the booking process and may vary depending on the property, length of stay or reservation dates.

By providing a credit or debit card, you authorize Moab Utah Properties and/or its payment processor to charge the card according to the payment schedule associated with your reservation.

Guests are responsible for ensuring that a valid payment method remains on file.

Failure to make required payments may result in cancellation of the reservation.

Cancellation and Refund Policy

The cancellation policy applicable to your reservation will be disclosed before your reservation is completed and will also appear in your booking confirmation.

Cancellation deadlines are based on the property's local time in Moab, Utah.

Refunds, reservation credits or date changes will be handled according to the cancellation policy associated with the reservation.

Guests are encouraged to purchase appropriate travel insurance to protect against unexpected events including illness, flight cancellations, road closures, weather events, family emergencies or other circumstances that may affect travel plans.

Unless otherwise required by law or specifically stated in the reservation policy, Moab Utah Properties is not responsible for providing refunds for circumstances outside our control.

Check-In and Check-Out

Check-in and check-out times will be provided with your reservation confirmation and arrival instructions.

Early check-in and late check-out are not guaranteed and must be approved in advance.

Unauthorized early arrivals or late departures may result in additional charges.

Guests are responsible for reviewing arrival instructions before traveling to the property.

Occupancy

Maximum occupancy is determined separately for each property and may not be exceeded without prior written approval.

Only registered guests may occupy the property overnight.

Parties, events or large gatherings are prohibited unless specifically authorized in writing by Moab Utah Properties.

Violation of occupancy or event restrictions may result in additional charges and/or immediate termination of the stay without refund.

Property Use

Vacation rental properties are provided for residential vacation lodging purposes only.

Guests agree to treat the property, furnishings, appliances, amenities and surrounding areas with reasonable care.

Guests may not engage in unlawful activity on the premises.

The use of the property must comply with applicable homeowners association rules, neighborhood restrictions, county or municipal regulations and property-specific house rules.

Noise and Neighbor Consideration

Guests must respect neighboring properties and observe applicable quiet hours.

Excessive noise, disruptive behavior, unauthorized parties or repeated complaints may result in termination of the reservation without refund.

Please remember that many of our vacation rentals are located within residential communities.

Smoking

Smoking and vaping are prohibited inside all Moab Utah Properties vacation rentals unless a property specifically states otherwise.

Guests may be responsible for additional cleaning, deodorizing or remediation expenses resulting from smoking or vaping inside a property.

Pets

Pets are permitted only at properties specifically identified as pet-friendly and only when included in the reservation.

Applicable pet fees must be paid before arrival.

Guests are responsible for damage, excessive cleaning or other costs resulting from their pets.

Unauthorized animals may result in additional charges or termination of the reservation, subject to applicable laws regarding service animals.

Damage to the Property

Guests are responsible for damage caused by themselves, members of their party or their invited guests beyond normal wear and tear.

Guests must promptly report accidental damage to Moab Utah Properties.

Moab Utah Properties reserves the right to charge the payment method on file for damage, missing items, excessive cleaning, unauthorized pets, smoking, rule violations or other costs resulting from the guest's stay, to the extent permitted by law and the applicable reservation agreement.

Cleaning

A standard departure cleaning is included or charged with the reservation as disclosed during booking.

The cleaning fee does not cover excessive cleaning resulting from unusual conditions, excessive trash, stains, damage, smoking, unauthorized pets or other conditions beyond ordinary use.

Additional cleaning charges may apply when necessary.

Bugs, Wildlife and Desert Conditions

Moab is located in a desert environment. Guests may occasionally encounter insects, spiders, rodents or other wildlife in or around vacation rental properties.

Our properties receive routine cleaning and pest-management services; however, the presence of occasional insects or wildlife does not necessarily indicate that a property is improperly maintained.

Guests should keep doors and windows closed when appropriate and promptly report significant pest concerns so they can be addressed.

Pools, Hot Tubs and Community Amenities

Some properties provide access to swimming pools, hot tubs, recreational facilities or other amenities.

Certain amenities may be managed by homeowners associations or third parties and may be seasonal, temporarily unavailable, subject to maintenance or governed by rules outside the direct control of Moab Utah Properties.

Amenity availability cannot be guaranteed.

Guests use pools, hot tubs and recreational amenities at their own risk and are responsible for supervising children at all times.

Internet, Television and Utilities

Internet service, television service and utilities are provided as conveniences when available.

Service disruptions may occur because of weather, utility providers, equipment failure or circumstances outside the control of Moab Utah Properties.

Moab Utah Properties will make reasonable efforts to assist with reported service problems but cannot guarantee uninterrupted internet, television or utility service.

Maintenance and Repairs

Guests must promptly report maintenance concerns or unsafe conditions.

Moab Utah Properties and authorized contractors may enter the property when reasonably necessary to perform emergency repairs, address maintenance concerns, protect the property or comply with applicable laws.

We will make reasonable efforts to minimize disruption to guests.

Property Availability and Unforeseen Circumstances

In rare circumstances, a reserved property may become unavailable because of significant maintenance issues, property damage, utility failure, government action, natural disaster or other circumstances beyond our reasonable control.

If this occurs, Moab Utah Properties may attempt to provide a reasonably comparable property when available.

If a suitable substitute cannot be provided, our liability will generally be limited to refunding amounts paid for the affected portion of the reservation, except where otherwise required by law.

Weather and Outdoor Conditions

Moab is an outdoor recreation destination and weather conditions may change rapidly.

Moab Utah Properties is not responsible for road closures, park closures, weather conditions, air quality, river conditions, trail conditions or interruptions to recreational activities.

Guests are responsible for evaluating travel and outdoor conditions and determining whether activities are appropriate for themselves and their party.

Personal Property

Guests are responsible for securing their vehicles and personal belongings.

Moab Utah Properties and property owners are not responsible for lost, stolen, damaged or abandoned personal property except to the extent liability cannot legally be excluded.

Guests should contact us promptly regarding items believed to have been left behind.

Shipping and handling charges may apply to returned items.

Assumption of Risk

Guests acknowledge that vacation rental properties and activities in the Moab area may involve inherent risks, including stairs, balconies, pools, hot tubs, outdoor terrain, weather conditions and recreational activities.

Guests are responsible for exercising appropriate care and supervising children and other members of their party.

Limitation of Liability

To the fullest extent permitted by applicable law, Moab Utah Properties and property owners will not be liable for indirect, incidental, consequential or special damages arising from a guest's stay, use of a property, interruption of services or circumstances outside our reasonable control.

Nothing in these Terms is intended to exclude liability that cannot legally be limited or excluded.

Website Information and Property Descriptions

We make reasonable efforts to ensure that property descriptions, photographs, rates, amenities and availability are accurate.

Furnishings, décor, landscaping and other property features may change over time.

Minor differences between photographs and the condition of a property at the time of arrival do not necessarily constitute grounds for cancellation or refund.

Guests should contact Moab Utah Properties before booking if a particular amenity or feature is essential to their stay.

Website Content

Unless otherwise stated, the content, photographs, graphics, logos, text and other materials appearing on our website are owned by or licensed to Moab Utah Properties.

Content may not be reproduced, distributed, sold or commercially used without prior written permission.

Third-Party Links

Our website may contain links to third-party websites, attractions, restaurants, services or other resources.

Moab Utah Properties does not control these third parties and is not responsible for their availability, accuracy, products, services or policies.

Chargebacks and Payment Disputes

Guests agree to contact Moab Utah Properties promptly if there is a concern regarding a reservation charge so that we have an opportunity to review and address the matter.

Filing a payment dispute or chargeback does not eliminate obligations under the reservation agreement or cancellation policy.

Documentation relating to the reservation, payment authorization, cancellation policy and guest communications may be provided to the applicable financial institution when responding to a payment dispute.

Governing Law

These Terms and Conditions and reservations with Moab Utah Properties are governed by applicable federal law and the laws of the State of Utah.

Any dispute shall be handled in accordance with applicable Utah law and any dispute-resolution provisions contained in the guest's individual rental agreement.

Changes to These Terms

Moab Utah Properties may update these Terms and Conditions periodically.

The terms applicable to a reservation will generally be those in effect when the reservation is made, together with any property-specific agreement or policies provided during booking.
